Terms and Conditions
CONSUMER DISCLOSURE NOTICE:

Please read the terms & conditions carefully, as your deposit payment on a trip signifies acceptance of the terms & conditions & the general information contained in the brochure. These trips are arranged by Worldwide Motorcycle Tours, Inc. (hereinafter "WMT"). It has made the travel arrangements as agent for the transportation carriers & other suppliers (SUPS) of services connected with the tour, all of which are independent contractors. WMT in no way owns or operates the vehicles or facilities to be used during the trip, & does not guarantee performance by, or assume responsibility for the acts &/or omissions of SUPS, their employees, agents, etc. All bookings are accepted subject to the conditions imposed by SUPS & WMT, including, but not limited to, the motorcycle providers, airline, rail, coach, hotel, restaurants, insurance & other companies, firms or persons concerned with the trip. WMT will make no refund in the event of their delay, cancellations, overbooking, strike, force majeure or for elements of the package not used by customer. If there is a difference between WMT conditions and those published by a SUP, the conditions of SUP shall apply. As a condition of participation, customer hereby agrees to now and forever hold harmless and indemnify WMT, its owners, officers, agents and employees from and against any and all claims, losses, damages, causes of action, suits and liability of every kind, including all expenses of litigation, court costs, and attorney's fees, for any property damage, injury, death, or financial losses associated therewith, arising from or in connection with participation in the trip. Price quoted is per person double occupancy. WMT reserves the right to cancel a trip, change the itinerary or adjust rates whenever in its sole judgment conditions warrant, or if WMT deems it necessary for your comfort, convenience or safety. WMT reserves the right to correct an error in the advertised price prior to your departure. Trips outside the USA require a valid U.S. passport or other acceptable forms of citizenship proof. You are responsible for, & release WMT from passport, visa, vaccination requirements & safety conditions in travel destinations. WMT strongly recommends you purchase appropriate travel/medical/baggage/cancellation insurance for the trip, which is available from WMT. For medical info., call Public Health at 301-443-2403, & for travel advisories US State Dept. at 202-647-5225, www.state.gov. A contract is made when your reservation & payment are accepted by WMT in its home office in Massachusetts & any disputes shall be resolved by arbitration in accordance with the Commercial Rules of the American Arbitration Association governed by Massachusetts law with enforcement subject to exclusive jurisdiction and venue in the courts of Worcester County, Massachusetts. In calculating the cost of your trip, WMT has relied on your consent to these terms & in the absence of this release, the trip cost would have been higher.

Payment:

Late payments & returned checks are subject to a $50 fee per person. Late payments may cause auto cancellation of your booking and charges will apply.

Travel Documents:

Valid passport is required for international travel. Passport & Visa & other documentation is your responsibility & cost. No refunds can be offered to individuals without required documents.

Cancellations and Refunds:

All cancellations must be in writing to our office & are effective 1st normal business day received. Trip cancellation insurance is available & recommended, but not included. Cancel for any reason, are a no-show, auto cancelled for no final payment, charges are calculated as of the first business day cancellation notice is effective & the following charges will apply to the total trip amount:

$250 administrative fee to WMT, plus non-refundable deposits paid to SUPS and charges imposed by SUPS.

Restrictions, Limitations & Exclusions: All cancellations must be in writing & are effective on the first normal business day (Mon-Fri, 9am-5pm ET) received by mail or fax in our office. All tickets/vouchers must be returned. Note: If you purchase any optional tours,deviations, special arrangements, non-refundable air tickets, or insurance these are not covered by the refund policy & are not refundable or transferable from the time purchased. More restrictions, limitations & exclusions apply from the insurance company.

No Air/Land Only Price:

Your trip begins & ends upon your arrival/departure at the designated gateway airport in the tour locale.

Disabilities:

We try to accommodate all needs. If you have a disability & require assistance when traveling, notify us ASAP.

Baggage:

An effort is made to handle your bags carefully. WMT is not responsible for & does not assume liability or accept claims for loss or damage to bags due to breakage, theft, wear & tear by the hotel, airline, bus or others who may handle your bags.


WORLDWIDE MOTORCYCLE TOURS, INC. RELEASE OF LIABILITY AND ASSUMPTION OF RISK

I HEREBY ACKNOWLEDGE I am aware that during my participation in a WORLDWIDE MOTORCYCLE TOURS, INC., tour program certain risks and dangers may arise, including, but not limited to, the hazards of operating and/or riding on a motorcycle, traveling in undeveloped areas, travel by boat, train, automobile, aircraft or other means of conveyance, the forces of nature, political unrest and accident or illness in remote regions without means of rapid evacuation or medical facilities. I am also aware and clearly understand that WORLDWIDE MOTORCYCLE TOURS, INC., a Massachusetts Corporation (hereinafter "Worldwide Motorcycle Tours"), has made the travel arrangements as agent for the transportation carriers and other suppliers of services, all of which are independent contractors. WORLDWIDE MOTORCYCLE TOURS will not have liability regarding the acts or omissions of suppliers, or the provision of medical care or the adequacy of any care that may be rendered.

I AM VOLUNTARILY PARTICIPATING IN THESE ACTIVITIES WITH THE KNOWLEDGE OF THE DANGERS INVLOVED AND HEREBY AGREE TO ACCEPT ANY RISKS.

AS LAWFUL CONSIDERATION for the agreement with WORLDWIDE MOTORCYCLE TOURS, to participate in such trips and activities, I hereby agree that I will not make a claim against WORLDWIDE MOTORCYCLE TOURS, or sue for bodily injury, emotional trauma, death and/or property damage, however caused, as a result of my participation in the tour program. I therefore release WORLDWIDE MOTORCYCLE TOURS, and its employees for any and all claims, actions and demands which are known or unknown, that I may have arising from my participation in the tour program.

This Release of Liability and Assumption of Risk agreement is binding on my heirs, legal representatives and assigns, and I hereby indemnify WORLDWIDE MOTORCYCLE TOURS from liability for any claims that are presented notwithstanding this release. If any portion of this agreement is unenforceable, the remaining portions shall remain in full force and effect.

I have read and agree to the terms and conditions of this release and I acknowledge that I have read and agree to the company's Standard Terms and Conditions.

I acknowledge that I am at least 25 years of age, have held a valid motorcycle operator's license for at least five years, and am capable of operating a motorcycle safely.

I understand that my participation will involve rental of a motorcycle from the local supplier and I assume responsibility for any damage to the vehicle or caused by it. I have an insurance policy that will cover such damage, or will purchase insurance for such risk.

I understand that WORLDWIDE MOTORCYCLE TOURS has travel insurance available for my purchase. This protects against losses resulting from trip cancellation or interruption, medical expense, emergency medial transportation and baggage/personal effects. Should I decline the offer of travel insurance, I understand that I am assuming any financial loss associated with my travel arrangements which otherwise may have been covered by travel insurance.
